Terms and Conditions for Online Consultation (Live Chat, Phone, and Email)

By using our online consultation services via live chat, phone, or email (hereafter referred to as "Remote Consultation"), you agree to the following terms and conditions:

 

1. Free Technical Support

fischer FZE (“fischer”) provides general information and non-binding technical assistance regarding the selection and use of fischer Products through Remote Consultation.

This is a voluntary, free of charge and ancillary support service made available by fischer for the benefit of its Users at its discretion.

Any guidance or responses provided during a Remote Consultation do not constitute: (i) a representation or warranty; (ii) a certification of suitability; or (iii) any other legally binding obligation of fischer.

 

2. Scope of Application

These Terms and Conditions exclusively govern all Remote Consultations and may be amended by fischer from time to time in its sole discretion.

The User accepts these Terms and Conditions [and the Data Policy] upon acknowledging them at the start of the Remote Consultation, regardless of whether they are referred to again during the interaction.

Any customer-specific general terms and conditions shall not apply, even if not expressly rejected.

 

3. Duty to Disclose Accurate Information

It is the User's sole responsibility to provide all accurate and relevant technical, project-specific, and site-related details needed for meaningful consultation. fischer is not obliged to verify the accuracy of the information provided and cannot be held liable if the advice given is based on incorrect or incomplete data.

The fact that specific information is provided for the Remote Consultation shall not affect the general – legally non-binding – nature of all Remote Consultations.

 

4. Independent Technical Validation

Users are fully responsible for validating any technical suggestions given by fischer with competent professionals, particularly with respect to compliance with:

· Technical data sheets

· Installation manuals

· Local UAE laws and building regulations

· Site-specific conditions

fischer does not certify or approve installations, best practice, nor guarantees regulatory compliance based on the advice. Users are encouraged to validate - through acclaimed third parties - any information provided by fischer.

 

5. No Role as Engineer or Consultant

fischer and its employees do not act as project consultants, structural engineers, architects or in any other professional capacity. The Remote Consultation is not a substitute for professional design or engineering services.

 

6. No Installation Confirmation

Remote consultation does not serve as confirmation that products have been installed correctly, in accordance with approvals, manuals, or the best practice of engineering.

 

7. Load Data Disclaimer

Unless expressly stated otherwise, all technical load values provided during a Remote Consultation are design values and are not to be interpreted as allowable, certified, or regulatory-approved values.

 

8. Limitation of Liability

fischer’s liability arising from or in connection with the Remote Consultation is limited. fischer's liability is excluded for damages other than those resulting solely from: intentional and grossly negligent misconduct of its representatives, or as otherwise required under applicable product guarantee or product liability laws. Fischer shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including without limitation, loss of profits, loss of business, loss of data, or interruption of business, even if advised of the possibility of such damages.

Notwithstanding the foregoing, fischer's total aggregate liability arising from or in connection with any Remote Consultation, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no event exceed AED 1,000 (UAE Dirham one thousand). The limitations and exclusions of liability set forth herein shall apply to the fullest extent permitted by applicable law and shall extend to fischer, its employees, representatives, and agents.

 

9. Legal Jurisdiction

For Users based in the United Arab Emirates, the applicable law shall be the laws applicable in the Dubai International Financial Centre.

The Courts of the Dubai International Financial Centre shall have jurisdiction over all disputes arising from the use of the Remote Consultation service.

 

10. Severability Clause

If any provision of these terms is deemed invalid, illegal, or unenforceable under applicable law, the remaining provisions shall remain unaffected. The invalid, illegal, or unenforceable provision shall be replaced with a valid, legal, and enforceable one that comes closest to the original commercial intent.
